Barbie® I Can Be Contest
Complete Official Rules

1. NO PURCHASE NECESSARY.

The “Barbie® I Can Be Contest (the "Contest") starts February 22, 2010 at 9.00 AM EDT and ends April 4, 2010 at 04:00 PM EDT ("Contest Period").

ELIGIBILITY: The Contest is open to permanent lawful residents of Canada who are three (3) years of age or older at the time of entry, excluding persons residing in the province of Quebec.  This Contest is void in all areas outside of Canada, and where prohibited or restricted by law. Employees, representatives and agents of Mattel Canada Inc., and Pebble Interactive Marketing Ltd, (collectively the “Sponsors”), their respective parent companies, affiliates, subsidiaries, printers, advertising and promotion agencies, contest administrators, as well as members of their immediate families, and persons with whom they are domiciled, households of such employees, representatives and agents are ineligible to participate.

 

An entrant under the age of thirteen (13), at the time of entry must have a parent or legal guardian consent to his/her participation in the Contest. The Sponsors have the right at any time, and in their sole discretion to request proof of identification and parental consent from any entrant. Proof of identification and parental consent must be provided upon request. If a parent or legal guardian does not provide consent, or if proof of identification cannot be obtained the entry will be disqualified.

 

In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be deemed to be made by the authorized account holder of the e-mail address at the time of entry.  The authorized account holder is the natural person who is assigned an e-mail address by an Internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question.

 

2. HOW TO ENTER

Limit one entry per registration/per e-mail address.

 

Visit www.barbie.ca/icanbe and click on the contest bubble reading ‘Enter the Contest’.  Then click on the ‘Enter Now’ button.  Now select either to enter by video or written submission. Upload your video or enter your story into the relevant upload fields once you have it prepared. Then complete your profile details. Entrants will need to provide either a video or written submission and complete the form with their name, age, present address, correct telephone number and correct email address. If the details provided are not working and correct, a new winner will be pulled immediately.  Select the “SUBMIT” button and you will be automatically entered into the Contest.

 

SUBMISSION REQUIREMENTS: Each submission must be approximately 2 minutes long and cannot exceed 2MB.  Only .mov, .MP4 and .wmv formats are accepted.  Each submission will be tied to one primary entrant. In the event that more than one person works on the submission, the submission will be entered under the name of the primary entrant. In the event of a dispute, the entry will be deemed to have been made by the registered subscriber of the e-mail address provided at the time of entry.  The submission must be the entrant’s own original work, and must not have been previously published, released or distributed in any form.  The submission must not infringe the copyright, trade-mark, privacy or other personal or proprietary rights of any individual.  Music in a video submission must be original, and must not require any clearance for the Sponsors to use or post on public websites or to use in a public forum of any kind.  The submission must not contain or reference any names, products or services, trade-marks, logos, trade dress or promotion of any company other than Mattel Canada Inc.  If any persons other than the entrant appear in or are referred to in the video submission, the entrant is solely responsible for obtaining consent prior to the submission.  Submissions that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, or otherwise contain inappropriate content or objectionable material may be disqualified at the Sponsors’ sole discretion.  Any decision made by the Sponsors are final and binding.

 

 

3. PRIZES / ODDS

There is one (1) Grand Prize Package available to be won, consisting of:

  • One CDN$5,000.00 RESP payment, awarded as a cheque payable to the winner’s parent or guardian as a RESP for their future education; and
  • One (1) full set of the Barbie® ‘I Can Be’ doll collection.

 

Approximate Value of the Grand Prize is CDN$5,074.95. 

 

Prizes must be accepted as awarded and may not be exactly as shown.  The Sponsors, in their sole discretion, reserve the right to substitute any portion of the Grand Prize Package with a prize of equivalent value.  Some restrictions may apply.  The Prize is non-transferable.  Odds of winning are dependent upon the total number of eligible entries received.

 

4. PRIZE FULFILLMENT

To identify the potential prizewinner, on or about 04:00 PM EST on April 4, 2010, a representative of the Sponsors will cause one (1) computerized random selection to be made from all entries recorded on behalf of eligible persons from www.barbie.ca/icanbe contest database during the Contest Period.

 

Beginning on April 5, 2010, a representative of the Sponsors will attempt to contact the potential prizewinner initially by telephone. If the Sponsors are unable to contact the winner by telephone after at least three (3) attempts over three (3) successive days, a redraw from the same pool of entries will take place on 5 p.m. EDT on April 12, 2010, using the same method of selection outlined.  To be declared a winner, potential winners or their parent/legal guardian (if winner under the age of majority in his/her province of residence) must correctly answer a mathematical skill-testing question, and sign a declaration and release form within 3 business days of being contacted, and confirm they are available to accept the ‘Barbie® I Can Be Contest prize as awarded (collectively, the “Prize Claim”).

 

The Grand Prize will be provided to the winner before June 30, 2010 or within 6 weeks after the declaration and release form including winner's name, address (including postal code), valid telephone number, valid e-mail address and winner's parent/legal guardian signature of approval (if the winner is under the age of majority in their province of residence) has been received by Pebble Interactive Marketing Ltd., 139 Main Street, Suite 202, Unionville, On L3R 2G6. None of the Sponsors shall have any liability or responsibility whatsoever to the potential winner of a prize with respect to the Contest.

 

5. PRIZE CLAIM DEADLINES/RESTRICTIONS

The Prize Claim must be received by the Sponsor no later than April 30, 2010 or they shall be null and void. If the Grand Prize is unclaimed or unawarded, Mattel Canada, Inc. reserves the right to randomly select another participant from the same pool of entries, using the same method outline above. Any Prize Claim is subject to verification by an independent judging organization whose decisions are final and binding on all participants in all matters relating to this Contest.

 

GENERAL: All entries become the property of the Sponsors and will not be returned.

 

Each entrant agrees to waive all rights with respect to print and broadcast publicity.

By entering the Contest, each entrant, or his or her parent or legal guardian if under the age of majority, hereby consents to the Sponsors’ use of the entrant's photograph, voice, likeness and/or image, contents of the entry form, the entrant’s video or written submission, and the name and age of the entrant, without any further compensation for any future promotional activity.

 

Sponsors are not responsible for late, lost, damaged, misdirected, incorrectly addressed, incomplete, illegible, undeliverable, destroyed, or postage-due entries, prize claims or other conditions or occurrences which may affect an entrants' ability to get through on the internet during the Contest or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user's system occasioned by participating in the Contest, and entries which fail to fully comply with these Contest Rules and Regulations.

 

Entries are null and void and will be rejected if not obtained in accordance with these Official Rules through authorized, legitimate channels, or if any part is counterfeited, not original, mutilated, illegible, incomplete, forged, falsified, or tampered with in any way.

 

This Contest is subject to all applicable laws. By participating in the Contest, participants agree to be bound by these Official Rules and the decisions of the judging organization and waive any right to claim ambiguity in the Contest or these Official Rules. Winner and participants also agree to release, discharge, indemnify and hold harmless the Sponsors, and the officers, directors, employees, agents, successors and assigns of each, from and against any claims, including, but not limited to, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, use, loss or misdirection of any prize, or participation in any Contest-related activity or participation in this Contest, or any other error in the offering or announcement of any prize. Any person attempting to defraud or in any way tamper with the Contest will be ineligible for prizes and may be prosecuted to the full extent of the law. If it is discovered that one person has attempted to enter more than once per registration/e-mail address, that person will be automatically disqualified from the Contest. The Sponsors also reserve the right to disqualify such participants from further contests and contests conducted by Mattel Canada, Inc. without further notice.

 

No responsibility will be taken for any failure of the website or broadcast during the Contest or for any problems or technical malfunction of computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by Mattel Canada, Inc., on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to a participant's or any other person's computer related to or resulting from playing or downloading any material in the Contest.

 

The Sponsors reserve the right, to cancel, modify, or suspend the Contest, for any reason, including without limitation in the event of any printing, administrative error, a virus, bug, or any other cause beyond the reasonable control of the Sponsors, corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way. The sponsors are not responsible for preemption, cancellation, or interruption, in whole or in part.

 

6. PRIVACY

By submitting personal information to the Sponsors or their service providers and agents, entrants or their parents or legal guardians (where the entrant is under the age of thirteen (13) consent to the Sponsors collection, use and disclosure of such personal information, including photographs and likeness of participants, parents/legal guardians, and where applicable, participating children, for the purposes: (1) of administering and publicizing the Contest; (2) set out in these Official Rules; (3) of detecting and protecting the Sponsors, their affiliates, and other third parties against error and fraud and other illegal activity; and (4) as otherwise disclosed to you and for which we obtain your consent and as permitted or required by law. To the extent that a participant provides the Sponsors with personal information of another person, such participant represents that he or she has the authority and/or has obtained all necessary consents from such person to enable the Sponsors to collect, use and disclose such personal information for the purposes set forth above. Any inquiry concerning the personal information held by the Sponsor should be sent in writing to Privacy Officer, Mattel Canada Inc., 6155 Freemont Blvd, Mississauga, Ontario, L5R 3W2.
